These Terms of Use govern the use of the “Elternkompass” app (the “App”) and its features. The provider and contracting party is:

Deviating or supplementary terms of the user do not become part of the contract unless the provider expressly agrees to them.
The App offers parents general parenting guidance: short lessons, a shareable family playbook, reflection notes and an AI-assisted “Situation Helper”. Some features are free; certain features require a paid subscription.
The App does not replace medical, psychological, therapeutic or legal advice. The AI Situation Helper generates automated responses; you are interacting with an AI, not with a person. Content and recommendations are non-binding orientation and do not replace professional assessment of the individual case.
The App can initially be used without an account (as a “guest”). Some features (e.g. sync, the Situation Helper) require an account. Registration details must be truthful, and login credentials must be kept confidential. The App is intended for adults (parents/legal guardians) and not for use by children.
Paid subscriptions are handled exclusively as in-app purchases via the Apple App Store. The payment contract for the subscription is concluded with Apple; Apple’s terms and payment conditions apply. The provider receives only the subscription status from Apple, not your payment data.
Subscriptions renew automatically unless cancelled in good time before the end of the term. Management, cancellation and any refunds are handled via the subscription settings of your Apple account.
For digital content and services, the statutory right of withdrawal may expire early if performance began with your express consent before the end of the withdrawal period and you confirmed that you thereby lose your right of withdrawal (Sec. 356(5) German Civil Code). Purchases and any refunds are handled via Apple.
The provider grants you a simple, non-transferable, revocable right to use the App within the agreed scope for private purposes. Any use beyond this – in particular reproduction, modification, distribution or commercial exploitation of the content – is not permitted without prior consent.
You undertake not to use the App abusively or unlawfully. Do not enter full names or clearly identifying details – in particular about third parties – into the AI Situation Helper. You are responsible for the content you enter.
The provider endeavours to keep the App available as uninterruptedly as possible but does not owe continuous availability. Maintenance, technical faults or circumstances beyond the provider’s control may temporarily limit availability.
The provider is liable without limitation for intent and gross negligence and for injury to life, body or health. For simple negligence, the provider is liable only for breach of a material contractual obligation (cardinal obligation) and limited to the foreseeable damage typical for such contracts. Otherwise liability is excluded. Liability under the German Product Liability Act remains unaffected.
The provider may amend these Terms with effect for the future insofar as this is necessary for good cause (e.g. changed legal situation, new features) and users are not thereby unreasonably disadvantaged. Users will be informed of material changes in an appropriate manner.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the state in which the user has their habitual residence remain unaffected.
